Michelle Hayes, Of Counsel

Michelle earned her Bachelor of Arts degree at the University of St. Thomas in Houston, Texas and then attended law school at the University of Notre Dame. After law school, Michelle clerked for the Honorable Kem Thompson Frost at the Fourteenth Court of Appeals in Houston. She next practiced civil trial and appellate litigation for nearly four years at Phillips & Akers, P.C. in Houston, before moving to Corpus Christi. In Corpus Christi, after serving for three years in the Appellate Division of the District Attorney's Office, Michelle served as a Staff Attorney, and later Senior Staff Attorney, to the Honorable Gregory T. Perkes at the Thirteenth Court of Appeals. As a staff attorney at the Court of Appeals, Michelle researched legal issues, made recommendations to the judges, and assisted the judges in drafting and editing opinions in a variety of complex civil appeals, including original proceedings.

Today, Michelle focuses her practice on civil appellate law and trial litigation support. She has extensive experience in medical-malpractice defense, premises-liability defense, products-liability defense, contract cases, and consumer issues. Michelle's areas of interest include evidentiary questions as they relate to the discovery process and trial of cases. In the recent past, Michelle served on the State Bar of Texas' Committee for the Administration of the Rules of Evidence.

By way of background, Michelle was born and raised in Houston, Texas, but considers herself a South Texan by marriage. Her husband, Patrick, hails from Corpus Christi and is a sixth-generation Texan. Together, they are active in their community. Michelle has served on the Advisory Board of John Paul the II High School and as President of the Advisory Board of Christ the King Catholic School, both of which are in Corpus Christi. Michelle volunteers regularly with a non-profit Montessori program. She also serves as a volunteer coach and judge for an interscholastic academic competition held each spring.

Noteable Cases
  • Marinecorp Int'l, Ltd. v. The Chopper Group, LLC et al., No. 01-14-707-CV, 2016 WL 1382168 (Tex. App.-Houston [1st Dist.] Apr. 7, 2016, pet. denied) in the Court of Appeals for the First District of Texas, at Houston. Drafted winning civil appellate brief in a complex contract dispute between a landlord and tenant.
  • Morrison v. Amway, 517 F.3d 248 (5th Cir. 2008). Drafted winning appellants' brief to obtain reversal of erroneous $6,000,000 judgment entered against wronged plaintiffs after arbitration.
  • Obtained a defense verdict for a fountain manufacturer and $162,000 judgment on counterclaim and for attorney fees in a contract-warranty case (second chair, handled pleadings and discovery, including all depositions).
  • $750,000 personal-injury suit against car dealership dismissed because of strong performance at plaintiff's deposition.
  • "Undefeated streak" in premises-liability motions for summary judgment filed on behalf of major retailer.
  • Acting pro bono, filed Truth in Lending Act suit against major lending corporation in federal district court and obtained prompt, very favorable settlement for low-income client.
