Portia Bott, Of Counsel

Portia was born and raised in Corpus Christi. Upon her return after law school, she clerked as a Briefing Attorney for the Thirteenth Court of Appeals for the Hon. Chief Justice Paul W. Nye, Hon. Justice Gerald T. Bissett, Hon. Justice Norman Utter, and the Hon. Justice Bonner Dorsey.

After leaving the Court, she joined a multi-office South Texas defense firm where she handled cases at trial and on appeal in both state and federal courts. She has represented defendants in personal injury cases products liability, auto, oilfield and trucking cases, and professional liability cases, as well as defamation, employment, and civil rights cases all over South Texas.

Portia handled numerous appellate cases along the way in both state and federal court systems, becoming Board Certified by the Texas Board of Legal Specialization in Civil Appellate Law in 1991. She also has considerable experience in insurance coverage matters and in prosecuting and defending numerous bad faith claims in both the first and third-party contexts throughout Texas. She has written and presented CLE papers on topics involving insurance coverage and insurance law. Her most recent CLE paper is entitled, "The Tilley Follies: What Happens if It's the Lawyer's Fault?" presented at the State Bar of Texas's 9th Annual Advanced Insurance Law Course (2012). A representative sample of her appellate decisions involving insurance coverage and/or bad faith law are: TIC Ins. Co. v. Sedgwick James of WA, 276 F.3d 754 (5th Cir. 2002); American Motorists Ins. Co. v. Fodge, 63 S.W.3d 801 (Tex. 2001); In re Daley, 29 S.W.3d 915 (Tex. App.-Beaumont 2000, orig. proceeding); St. Paul Surplus Lines Ins. Co. v. Dal-Worth Tank Co., 917 S.W.2d 29 (Tex. App.-Amarillo 1995), aff'd in part, rev'd in part, 974 S.W.2d 51 (Tex. 1998); Maryland Ins. Co. v. Head Indus. Coatings and Servs., Inc., 906 S.W.2d 218 (Tex. App.-Texarkana 1995), rev'd, 938 S.W.2d 27 (Tex. 1996); and State Farm Fire & Cas. Co. v. Wade, 827 S.W.2d 448 (Tex. App.-Corpus Christi 1992, writ denied).

Her legal career led her to Dallas, then Austin, where she tried (first-chair) employment, commercial, medical and legal malpractice, and personal injury cases. Portia has returned to South Texas and assists the firm in litigation, insurance coverage, and bad faith cases, as well as with appeals and original proceedings.
